Compromise agreements defined

A compromise agreement is an agreement between you and your solicitor that is used if your employment is terminated and you have a potential legal claim against your employer.  In exchange for your promise to waive your right to bring a legal claim against your employer, your employer will pay you compensation and possibly give other benefits too.

Why you need to seek legal advice

Without legal advice, a compromise agreement is legally invalid, meaning you will not be able to rely on it if your employer subsequently breaches the agreement.  You must receive “independent” advice, that is advice free of the influence of your employer.  We do, of course, provide totally impartial legal advice.

Whilst there is no law stating that your employer has to pay for your legal costs, generally speaking, employers will pay or at least contribute.

Compromise agreements are negotiable

Greenwich compromise agreement solicitors will advise you on the upper and lower amounts of compensation generally given in circumstances similar to your circumstances.  Where the package you have been offered is generally below what could be expected, we will be able to negotiate a better package on your behalf.  Generally speaking, the underlying issue for which the agreement is offered does not, in our experience, materially impact on the amount that you can get.

Asking for an agreement where one has not been offered

Whilst it is customary for employers to offer compromise agreement, it is possible for employees to ask for one where their employment is being terminated and a strong legal claim exists against the employer.  You should bear in mind that asking for a compromise agreement will signal to the employer that you wish to terminate your employer, which may be disadvantageous to you if your employer hasn’t yet made his mind up.
